Minister requests assistance of the Prosecutor’s Office in returning privatised lakes to the state2015-03-03
Minister of Environment, Kęstutis Trečiokas, has applied to the Panevėžys Regional Prosecutor’s Office requesting it to protect the public interest of returning six privatised lakes or their parts to the state.
Lakes Vastelis (Vastalis), Paneikiškis and Vaitonka in Zarasai district, Raistežeris and Iženas in Utena district and Oklis in Rokiškis district or their parts were privatised following the restitution or transfer of ownership in them by decisions of the National Land Service (NLS) under the Ministry of Agriculture, although information from the NLS shows they were the property of the state until 1940. The Law on Water states that surface water bodies owned by the state until 1940 are the exclusive property of the state. Therefore their transfer to other persons is not allowed.
‘We cannot stay indifferent and ignore what is happening. We have applied to the Prosecutor’s Office and hope that we will succeed in preserving these lakes, which are the invaluable property of both the state and all of us,’ says Minister Kęstutis Trečiokas.
In defence of the public interest, the Panevėžys Regional Prosecutor’s Office should refer the matter to the court for the annulment of the NLS decisions on the restitution or transfer of ownership in these lakes or their parts.
